These Terms of Service ("Terms") govern your access to and use of nexadvisor.net (the "Site") and the Trusted Advisor matchmaking service (the "Service") operated by NexAdvisor Inc. ("NexAdvisor," "we," "us," or "our"). By accessing the Site or submitting a request through our forms, you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Service.
NexAdvisor connects businesses seeking technology procurement guidance ("Clients") with independent Trusted Advisors who provide vendor-neutral sourcing and advisory services across categories including AI infrastructure, data centers, telecom, cybersecurity, and as-a-service technology. NexAdvisor acts solely as a matchmaking intermediary. We are not a party to, and do not control, the advisory relationship, engagement terms, or any transaction between a Client and a Trusted Advisor.
The Service is intended for business use. By submitting a request, you represent that you are at least 18 years old, are authorized to act on behalf of the organization you represent, and that the information you provide is accurate and complete.
NexAdvisor does not charge Clients for advisor matching. Trusted Advisors in our network are compensated through the vendor channel, consistent with standard industry practice for technology advisory and brokerage services. This does not create any fee obligation, agency relationship, or fiduciary duty running from NexAdvisor to any Client or vendor.
Trusted Advisors matched through the Service are independent third parties, not employees, agents, or representatives of NexAdvisor. NexAdvisor:
Any agreement you enter into with a Trusted Advisor or vendor is solely between you and that party.
When using the Site, you agree not to:
The Site, including its design, text, graphics, and underlying code, is owned by NexAdvisor Inc. and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from the Site without our prior written permission.
The Site and Service are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, NexAdvisor Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or Service, or any engagement with a Trusted Advisor introduced through the Service, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless NexAdvisor Inc., its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your engagement with any Trusted Advisor or vendor introduced through the Service.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles, unless otherwise required by applicable law.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.
